These Terms of Use govern your access to and use of the SellGadgets website. They are separate from our service Terms and Conditions, which apply when you actually sell a device to us — please read both.
Acceptance and scope of these terms
By accessing or using the SellGadgets website at sellgadgets.in (the "website"), you agree to these Terms of Use. If you do not agree, please do not use the website.
These Terms of Use cover the website itself — browsing, checking a quote, creating an account, and managing a pickup. Our separate service Terms and Conditions cover the actual sale of your device, including how quotes are locked, how doorstep pickup and inspection work, and how instant UPI payment is made. If there is any conflict between the two documents for a specific sale, the service Terms and Conditions govern that sale.
SellGadgets is a sell-only service: you can sell a used phone, laptop, or tablet to us, but we do not sell devices or refurbished products through this website. The website and the service are operated by NextGen Gadgets ("the Company").
The Company may update these Terms of Use from time to time, for example to reflect changes in the website or the law. The current version will always be available on this page. If you continue to use the website after an update, you accept the revised terms.
Acceptable use of the website
You may use the website to get an indicative and a locked, condition-based quote, to arrange a free doorstep pickup, and to track your sale. You must be at least 18 years old, be a resident of India, and use the website only for these lawful purposes.
You agree not to submit false, inaccurate, or misleading information about a device, its condition, or your identity, and not to use the website to offer a device that you do not own or that is lost, stolen, counterfeit, or subject to a loan, EMI lock, or insurance claim.
You also agree not to attempt to gain unauthorised access to any part of the website or its systems; not to scrape, copy, reverse-engineer, or overload the website or the quoting engine; not to introduce viruses or other harmful code; and not to misuse quotes for resale, price manipulation, or any commercial purpose other than selling your own device to us.
We may warn, suspend, or block your access to the website, and decline or cancel a pickup, if we reasonably believe you have breached these terms or are using the website fraudulently. This does not affect any locked price already confirmed for a genuine device under the service Terms and Conditions.
Your account and responsibilities
To get a quote, arrange a pickup, and receive instant payment, you may need to create an account using your mobile number, email address, and UPI details. Verification is usually done through a one-time password (OTP) sent to you.
Keep your login credentials and OTPs confidential and do not share them with anyone. You are responsible for all activity that takes place under your account.
Please make sure the contact number, pickup address, pincode, and UPI ID you provide are accurate and current, since we rely on them to reach you, pick up the device, and pay you instantly. Incorrect details can delay or prevent pickup or payment, and we are not responsible for a payment sent to a UPI ID that you entered incorrectly.
If you believe your account has been accessed without your permission, or your details have been misused, tell us promptly at support@sellgadgets.in so we can help secure it.
Intellectual property and trademarks
The website and everything on it — including the text, graphics, page layout, design, the "locked price" branding, and the SellGadgets name and logo — are owned by the Company or its licensors and are protected by Indian and international intellectual property laws.
"SellGadgets", along with related logos and taglines, are trademarks of the Company. You may not use them, or anything confusingly similar, without our prior written permission.
You may view and print pages from the website for your own personal, non-commercial use of the service. You may not otherwise copy, reproduce, republish, distribute, modify, or commercially exploit any part of the website without our written consent.
Device brand names, model names, and logos shown to help you identify and quote your device belong to their respective owners. They are used only for identification and do not imply any endorsement of, or partnership with, SellGadgets.
Third-party links and services
The website may link to, or rely on, services provided by third parties — for example, UPI and banking partners for payment, maps for locating your pickup address, or logistics partners for doorstep pickup. These are offered for your convenience.
The Company does not control these third-party websites and services and is not responsible for their content, availability, accuracy, security, or privacy practices. When you use them, you do so under their own terms and policies, which we encourage you to read.
A link to a third-party service does not mean the Company endorses it. Any dealings you have with a third party through the website are between you and that third party.
Site availability and no warranty
We work to keep the website available, secure, and up to date, but the website is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the extent permitted by law.
We do not guarantee that the website will be uninterrupted, timely, error-free, or free of viruses, or that the information shown will always be accurate or current. Indicative quotes shown on the website are estimates based on the details you provide; only a locked price confirmed within the flow applies to your sale, and that price is subject to the service Terms and Conditions.
We may change, suspend, or discontinue any part of the website at any time, including for maintenance, without notice. This no-warranty relates to the website only. It does not reduce your statutory rights as a consumer in India, and it does not affect the honest, locked-price and free-pickup commitments set out in our service Terms and Conditions.
Limitation of liability
To the extent permitted by law, the Company, and its directors, employees, and partners, will not be liable for any indirect, incidental, special, or consequential loss arising out of or connected with your use of, or inability to use, the website — including loss of data, loss of profits, or losses caused by third-party services linked from the website.
Nothing in these terms limits or excludes any liability that cannot be limited or excluded under Indian law, including liability for fraud or for death or personal injury caused by our negligence.
This clause is about the website. The Company's responsibilities for an actual device sale — including honouring the locked price, providing free doorstep pickup, and making instant UPI payment — are set out in, and governed by, the service Terms and Conditions.
Governing law and contact
These Terms of Use are governed by and construed in accordance with the laws of India. Subject to any right you have to approach the consumer dispute redressal forums under the Consumer Protection Act, 2019, the courts at Bengaluru, Karnataka, India will have jurisdiction over any dispute relating to the website.
